
Hulk Hogan’s Family Files Petition for Potential Medical Malpractice Investigation – The family of Hulk Hogan has filed a petition in Pinellas County, Florida, seeking additional time to investigate a potential medical malpractice claim related to the wrestling legend’s death.
The petition was filed last week on behalf of Hogan’s widow Melanie Sky Daily, his son Nick Bollea, and financial adviser Terry McCoy, who are representing Hogan’s estate. The filing requests a 90-day extension of Florida’s statute of limitations to allow further investigation before deciding whether to pursue legal action.
At this time, no lawsuit has been filed. The petition specifies that the family intends to look into possible claims involving Tampa General Hospital, Morton Plant Hospital, two Florida-based physicians, and “any and all other applicable health care providers.”
Daily previously stated to TMZ Sports that she planned to file a medical malpractice suit, claiming that Hogan’s phrenic nerve was “compromised” during one of his recent surgeries. She confirmed that an autopsy has been performed but declined to share details about the results. Clearwater Police are continuing their investigation into Hogan’s death.
Under section 95.11(5)(c) of Florida law, medical malpractice claims must typically be filed within two years of the incident or its discovery, and no later than four years from when the alleged malpractice occurred. The petition by the Bollea estate grants a 90-day extension to that period while the family investigates their legal options.
Although Hogan’s death occurred a little over two months ago, the potential negligence cited by the family is reportedly tied to a neck surgery performed in May 2025, which would have triggered the statute’s time limit. Sources close to the matter told POST that this type of extension is a common procedural move in such cases, allowing attorneys to gather medical records and expert opinions before making a formal filing.
