
“American Nightmare” Lawsuit Against WWE & Cody Rhodes Moves Forward – The ongoing lawsuit filed by Wesley Eisold, frontman of the punk band American Nightmare, against WWE, Cody Rhodes, and Fanatics continues to develop, with all parties submitting a joint motion on May 31 requesting additional time to respond as settlement discussions remain active.
The motion details that the defendants have recently provided additional disclosures, prompting Eisold to revise his settlement demand. Negotiations are still underway to address structural and scope issues regarding a potential resolution.
The United States District Court in Los Angeles granted the request, officially pushing the Scheduling Conference from July 25 to August 15.
Eisold originally filed the lawsuit in November 2024, claiming ownership of the “American Nightmare” trademark—also the name of his band—and alleging that Rhodes and WWE violated a prior agreement made in 2021.
Under that agreement, Rhodes was permitted to use the phrase under strict conditions tied to his name and wrestling imagery. Eisold now accuses the defendants of breaching the deal and creating consumer confusion through unauthorized merchandise.
Eisold is seeking $900,000 in damages, a jury trial, and an injunction to prevent further violations.
With settlement talks ongoing, the case remains fluid, and further developments are expected in the coming weeks.
