
Cody Rhodes and WWE Granted Extension in “American Nightmare” Lawsuit – WWE, Cody Rhodes, and Fanatics have been granted additional time to respond to a lawsuit filed by Wesley Eisold, the lead singer of a Boston-area hardcore punk band. The defendants must now submit their official response by Monday, April 7.
The legal dispute centers around the “American Nightmare” trademark, which Eisold claims ownership of through his band of the same name. According to the lawsuit, Eisold and Rhodes reached an agreement in 2021 that allowed the WWE star to use the phrase on merchandise—but not to trademark it. The agreement stipulated that Rhodes’ name, likeness, or wrestling-related imagery must make up at least 75% of the design. As part of the deal, Eisold also received a $30,000 payment.
Eisold alleges that WWE and Fanatics have breached this agreement by selling “American Nightmare”-branded merchandise that does not prominently feature Rhodes’ identity or wrestling-related imagery. He claims that this has caused consumer confusion, with fans mistakenly associating Rhodes’ merchandise with his band and vice versa.
The lawsuit seeks a jury trial and a ruling against Rhodes for breach of contract and trademark infringement. Additionally, Eisold is suing WWE and Fanatics for allegedly inducing the breach and violating trademark laws. He is requesting $900,000 in damages, a court order to stop the sale of the disputed merchandise, and reimbursement for legal fees.
With the extension granted, WWE, Rhodes, and Fanatics now have more time to prepare their defense against the allegations.
